Just because it is a gold seal box does not imply that it is a good box, it could have had many thousands of miles use since it was reconned.
It may be a simple problem with the gearstick jumping out of the selectors so take the lever out and have a look. Make sure that the locating pins and the cups and springs are all there. What cc box is it? If it is an 803 I would not bother with it. If it is a 948 then if it works I would fit the 803 gear lever assembly and keep it.

If it is any good then keep it. You can still bolt the 803 lever to it to Keep the car looking original.

Not easily you can't! 803 lever has been fitted to a 1098 box - but it took some 'machining'! Ask Callyspoy!!
As for the lever being 'stuck' - I have seen this on a Mini box (same internals) - and it was simply because there was no oil and the syncro rings had stuck to the gear faces. A few squirts of oil and a bit of tugging - and all was fine. But of course - there could be much more sinister problems - one possibility being that the box was taken apart and the re-assembled with the interlocking 'bullets' in the wrong places!! I would say at £35 it's a bit of a gamble. As it sits it's basically worth nothing. Will they let you take it away and fiddle with it for a day - and if the lever comes free then pay £35, and if not -return it? Also worth popping the side cover off (squirt oil in here) and inspecting the little 'dog' teeth on second gear - if they are worn (compare with 4th gear which never wears) then the box is pretty useless anyway.
