Brake lights flicker whilst driving

Brake lights appear to work fine, however have had a few people flashing to indicate that the lights are flickering whilst car is in motion and not just when brake pedal is applied

Any clues ?

From the symptoms I would check for a bad earth.

How can it be a 'bad earth' ??? Are you sure there is no pressure in the system - not resting your foot on the pedal? Is the pedal returning ok (return spring in place) and the brakes releasing? Check also in case the two connections at the switch are close together and possibly touching. Otherwise - it must be a weak switch......
